The Supreme Court will hear the application to stay the issue of writs for the Bougainville general election this Thursday. The application was filed by Bougainville President, John Momis, and the Bougainville Executive Council. The three men bench of Deputy Chief Justice Ambeng Kandakasi, Justice Nicholas Kirriwom and Justice David Cannings sat today at the Waigani court house to hear the stay application. However they had to adjourn the matter to this Thursday to give time for Bougainville’s Electoral Commissioner to be served notice of this proceeding and he be allowed to be joined as a party. Loani Henao, lawyer representing Mr Momis, told the Supreme Court last week that Bougainville’s Electoral Commissioner has indicated in a letter to the Speaker of Bougainville’s House of Representatives Simon Pentanu that the writs will be issued this Friday. The application is to restrain the Speaker from issuing the writs until a separate Supreme Court Reference filed by Mr Momis and the BEC is dealt with. The Special Reference seeks an interpretation of provisions of the National Constitution that relate to a citizens’ right to be elected into public office.
