A JUDGE is expected to make a ruling on Thursday on an application filed by sitting MP Alfred Manase challenging the validity of the Kandep judicial recount result. The application is before Justice David Cannings in the National Court. Manase’s lawyer Christine Copland made submissions supported by five affidavits questioning the inclusion of the three ballot boxes from Kanean, Kinduli and Kitali. She said the returning officer’s decision to include the three boxes during the recount had breached a Supreme Court order. She submitted that according to sections of the Organic Law and orders by the Supreme Court and National Court, the court should:
NOT declare petitioner Don Polye the Kandep MP; DECLARE that the three ballot boxes should not have been counted; ORDER a further recount for the Kandep seat excluding the ballot papers from Kanean, Kinduli, Kitali, Titip and Laguni; BALLOT papers for Gini 1 and Tarapis be excluded from the recount; A TALLY of the ballot papers for Kanean, Kinduli and Kitali be removed from the recount tally and her client Manase be declared the duly elected Kandep MP; and, ORDER that costs of the recount and further recount and Manase’s application be paid by Polye and Electoral Commission.
