The National Court in Waigani today dismissed proceedings filed by Madang Governor Peter Yama in which he was seeking injunctive orders against police from inviting and interviewing him in relation to a bribery allegation. The allegation stems from the 2017 national election in which electoral officials Nixon Kavo and John Tumaing were allegedly bribed by Mr Yama K50 and K500 respectively. Both were charged and convicted by the National Court in Madang in 2018 and have both since appealed to the Supreme Court, which is pending. Police invited Mr Yama for interview but Mr Yama sought a stay before the National Court which was dismissed. He then had appealed to the Supreme Court last month which the High Court fully determined the facts on the merit in law, confirming there was no cause of action in that Mr Yama was not arrested nor charged for bribery. He was being investigated and given an opportunity to be heard. This is the third time Mr Yama has gone to the courts, this time filing an originating summons in the National Court, submitting that it is a human rights application. But the presiding judge, Justice Nicholas Miviri, ruled the matter has been dealt with by the Supreme Court and the National Court has no jurisdiction to re-hear the matter as a human rights originating summons.
