A man who formerly served in the Constabulary as a reservist was arrested today in Port Moresby for impersonation, issuing threats, extortion and receiving bribery. The suspect named as 36 year old Jack Tom of Tini Pin village Morobe Province was a former reservist attached with Town Police Station until Commissioner Manning scrapped the bulk of the reservist concept. The Papua New Guinea Government's SLIP Rule application seeking a review of the Supreme Court's decision in declaring the recalling of Parliament Sitting on November 2020 National Budget unconstitutional has been thrown out by the same court today. The court ruled that the application for leave to bring Slip Rule Application is refused because section 104(3) Constitution is a new argument not raised in arguments before. And in addition, that it is not a determinative argument re s.104(3) only applies to where an MP is absent in three consecutive meetings. It is arguable but it is a new argument and not a determinative issue. All grounds for slip or errors are refused. A full Supreme Court's bench will tomorrow hear the Slip Rule and A Stay application filed by the Attorney General Pila Niningi regarding the Supreme Court's decision on December 9 that ordered parliament to reconvene. Justice Derek Hartson adjourned the matter after hearing the applications this afternoon by the Attorney General's lawyer Nemo Yalo. Prime Minister James Marape says the Government is looking forward to the Parliament session on Wednesday. He said this after Speaker Hon. Job Pomat adjourned today’s session to Wednesday to seek clarification on the status of Kerowagi MP Hon. Bari Palma. “The Speaker, as Head of Parliament, has made his ruling,” Prime Minister Marape said. “We have complied and we look forward to Parliament on Wednesday.” Prime Minister Marape also confirmed that Speaker Pomat and Attorney-General Hon. Pila Niningi had both filed a slip rule application on some areas in the Supreme Court rulings of November 9th, 2020. The Papua New Guinea Alternate Government has signed a Vote of No Confidence motion against Prime Minister James Marape this afternoon. The motion was signed by 13 MPs led by Opposition Leader Belden Namah. Namah said the motion will be served through Parliament Business Committee at 1:30pm today. The Private Business Committee sits on Wednesday 1pm and will deliberate on the Motion. Once it is satisfied that this motion is valid and satisfied all requirements, it will be sent to the Speaker. The Speaker on Thursday 17th December will introduce the motion on the floor of Parliament and will adjourned Parliament for a week before a vote is taken. The Papua New Guinea Opposition has announced formally Member for Aitape- Lumi Patrick Pruaitch as Alternate PM from Crown Camp and a notice for a vote of No Confidence will be handed to the office of the clerk this afternoon. Pruaitch is thankful for the opportunity to be nominated as Alternate PM. The Papua New Guinea Parliament Speaker has adjourned parliament to Wednesday 16th December, 2020 at 10:00 am. The adjournment stemmed from doubts being cast on the parliamentary membership of Kerowagi MP Bari Palma who was declared bankrupt. Speaker Job Pomat said the adjournment would allow him to seek higher court's interpretation on whether Palma is capable of attending Parliament meetings. Unlike before, he said, his numerical support is very crucial at this time when numbers at of both the Opposition and the Government camps are even. The lobbying is intensifying. THE Marape led Government has successfully filed slip rule application challenging the last Wednesday's Supreme Court decision to have Parliament ordered to recall today (14th December). Minister for Justice and Attorney General, Pila Niningi announced this in a statement. "My lawyers have reviewed the Supreme Court decision on 9th December 2020 and we have respectfully view that the Supreme Court had glaringly slipped in its decision. This is a right that is available to us that we intend to exhaust," Mr. Niningi said. "At this time, we have filed an application to have the orders of the Supreme Court stayed pending the outcome. Prime Minister James Marape has announced the appointment of Ambassador Ivan Pomaleu as Secretary to the Prime Minister's Department. Amb. Pomaleu, a distinguished Papua New Guinean from Manus who worked as Managing-Director of Investment Promotion Authority and Ambassador to APEC, was appointed by the National Executive Council last week. Prime Minister Marape said: "Amb. Pomaleu will be Secretary to Prime Minister's Department under my vision of a flatter public service structure. "In this structure, department and agency heads report directly and only to their ministers and not to chief secretary as it was over the last 20 years, Prime Minister James Marape says the Government will follow all legitimate processes to defend itself and the systems of governance. He said the Opposition must follow all legal processes if they want to move a no-confidence vote against him as Prime Minister. He said this as today as Parliament sits tomorrow. "Our country is a democratic, country where the rule of democratic law prevails," Prime Minister Marape said. "Hence my Government will follow all legitimate processes to defend and run our systems of governance. " We look forward to tomorrow's Parliament. "My Government has the mandate, with the last vote on Prime Ministership being on May 30th, 2019." |
