Vital evidence needed to set up leadership tribunal to investigate Prime Minister O'Neill : Kaluwin9/10/2014 PUBLIC Prosecutor Pondros Kaluwin says he needs "certain vital evidence" before he could decide on whether to ask the Chief Justice to set up a leadership tribunal to investigate Prime Minister Peter O’Neill.
It is close to two months since the Ombudsman Commission referred the PM to the Public Prosecutor on three charges, which the commission alleges breached the Leadership Code. Yesterday Mr Pondros released a two-paragraph statement saying he needed additional evidence before making a decision. "I have fully considered the material referred to me by the Ombudsman Commission against Peter O’Neill, Member for Ialibu-Pangia Open and Prime Minister," Mr Kaluwin said in a statement. "I am of the view that there are certain vital evidence that are required for me to make an informed opinion on whether or not to refer the Prime Minister to the appropriate tribunal to conduct enquiries into allegations of misconduct in office." "I have today (yesterday) requested the Ombudsman Commission to collate those relevant evidence and submit them to me to assist me in the exercise of my powers under Section 27(2) of the Organic Law on Duties and Responsibilities of Leadership." The Ombudsman Commission referred Mr O’Neill to the Public Prosecutor on August 12, 2014 after it was satisfied that there was a prima facie against the PM. The referral was based on three allegations: Claims that the National Government did not follow administrative and financial processes in acquiring the UBS loan to purchase shares in Oil Search Limited, the sacking of Don Polye as the treasurer and making a statement on EMTV relating to the lack of official consultation on the matter. Under PNG law the Public Prosecutor has the discretion to bring or decline to bring proceedings against a leader under the Leadership Code for alleged misconduct in office. PNG Facts/ Post Courier
