OMBUDSMAN COMMISSION REFERS BELDEN NAMAH TO THE PUBLIC PROSECUTOR TO FACE LEADERSHIP TRIBUNAL14/4/2015 Vanimo-Green MP and former Opposition leader Belden Namah has been referred to to the Public Prosecutor by Ombudsman Commission for alleged misconduct in office.
Misconduct charges 16 in total include failure to declare his election expenses and failure to acquit public funds. Chief Ombudsman Rigo Lua and Ombudsman Phoebe Sangetari said in a joint statement that the Commission investigated the alleged misconduct in office by Mr Namah, which arose from his failure in upholding his duties and responsibilities of office under the Constitution and Organic Law on the Duties and Responsibilities of Leadership. "As required by Section 20(2) of the Organic Law on the Duties and Responsibilities of Leadership, the Commission notified the Leader, by a letter dated April 9, 2015, of its intention to refer the matter to the Public Prosecutor." The two Ombudsman said that after being satisfied that there was a prima facie case, that Mr Namah had been guilty of misconduct in office, the Commission decided to refer him to the Public Prosecutor for his independent deliberation. The Chief Ombudsman said the referral was in the hands of the Public Prosecutor who had the discretion to bring or decline to bring proceedings under the Leadership Code for alleged misconduct in office.
