An appeal to review a seven month jail term for former Police Commissioner, Sir Tom Kulunga took another twist at the Supreme Court, yesterday.
Parties including the State, Police Commissioner Jeffery Vaki and Sir Tom agreed through consent, for the higher court to rule against the conviction by the National Court. They say, the Supreme Court has discretion to do so. The three men bench led by Justice Panuel Mogish disagreed, ruling that the court can't be used as a rubber stamp. A hearing therefore had to commence and their arguments with evidences put forward on why parties took this action. A date will be set towards the end of October. Sir Tom whilst serving as the Police Commissioner on June sixteen was sentenced to seven months in prison for contempt of court charges, however he was granted a Supreme Court bail the same day. He is out on ten thousand kina bail awaiting his review. Three senior lawyers involved in the same case, Alfred Manase, Sam Bonner and Margaret Parua, also await a ruling on contempt charges by the Supreme Court. This is for an earlier unsuccessful attempt, to consent to certain orders when the court was about to make a ruling.
