THE National Court has summoned Police Commissioner Toami Kulunga to present himself in court and explain why he failed to follow a court order to reinstate a suspended officer.
Justice Colin Makail ordered Kulunga to appear before him next Friday, Dec 13, with an explanation on why he failed to reinstate suspended deputy police commissioner Geoffrey Vaki as ordered by Justice Nicholas Kirriwom on Oct 1 last year. Vaki, who had held the position of deputy Police Commissioner Operations, was suspended by Kulunga’s predecessor Garry Baki on disciplinary matters. He was stripped off his title and removed from the payroll four years ago. Makail on Tuesday told Vaki’s lawyer Sam Bona to make sure that commissioner Kulunga appeared in court personally to explain why he did not reinstate Vaki. Kiriwom had ordered that Vaki be reinstated to the Royal Papua New Guinea Constabulary as Assistant Commissioner “unattached” – meaning Kulunga had the option of giving Vaki a position at police headquarters or advertise the position of Chief of Operations (held previously by Vaki) which candidates, including Vaki, could apply for. But Kulunga terminated his employment on Oct 10, 2012. When the matter was again brought up at the National Court on Tuesday, neither Kulunga nor his lawyers were present in court. Bona then moved a motion asking Makail to grant consequential orders. With nobody to argue the case from Kulunga’s side, Makail considered Vaki’s case as serious and issued the order for Kulunga to present himself in court next Friday. Vaki said outside court that he had been keeping quiet about his case because of his respect for the commissioner and the police hierarchy. Comments are closed.
