The Governor for East Sepik Alan Birds comments in Parliament,against the Deputy Chief Justices is totally unwarranted and causes more disdain and disrespect for the Judiciary in this country.Especially comming from a leader who is a member of the law making body in the country. His outburst would have been in direct contempt and sub-judice to the proceedings if his comments were made outside of parliament sittings,were he is not covered under the "parliamentary privileges". It is also unbeccoming of him to be passionately embroiling himself in a private issue that does not concern him and the people of East Sepik. The issue in question is a defamation case that the former Prime Minister of PNG,Peter Oniel has taken out against Brain Krammer.Why it affects Bird is a wonder.In fact,the past few days have been filled with drama,where three half caste MP's have been vocal about issues facing another half caste,Krammer,(or percieved half caste)believing that their kind have been discriminated against in parliament. Here,the Governor lamented that "Directions"that S/CJ Kandakasi gave for Krammer step down was "a serious incursion of one arm of Government into another arm of Government".He talks as if he does not where the demarcation is, between the two arms of Government,and his contention that the Judge made an "order" against Krammer to step down is all but misleading. Governor Bird also seemed incompetent as a leader and more importantly as a law maker not to know who holds the judges accountable.The constitution is very clear on this.And the Deputy Prime Minister and the Minister for Justice and Attorney General rightly pointed our in a shuttle but confident assertion that yes,there is a body called the "Judicial Legal Services Commission" (JLSC) that administers a certain code of conduct that the judges abide by. So if he and his brother Krammer had issues against the judge,he simply had to file a complaint with the right body,instead of through a public media stunt or on fb where all of Krammers and his minions will run amock and make deragotory remarks that further brings the intergrity of our judiciary into uneccessary disrepute. The judge merely suggested to him that perhaps that was the proper and ethical thing to do.This was a private civil case of defamation by one party(Oniel) against another party(Krammer) and the way the case is going it would have the propensity to drag or compromise the integrity of the chair of the police minister into disrepute.That could be the only reason why the judge suggested that "perhaps"he should consider fighting this and other looming cases (such as the upcomming Yama arrest and his citizenship cases)privately and free from any percieved incursions into his official dutues .It is a private question of ethics and moral duty for the minister to make the call himself to step aside. In any democracy,be it the Westminster parliamentry system,where we are modelled from, or the US democratic system,it is always the the norm and the noble and proper thing for a public office holder to step aside when his/her personal or public integrity are called into question. Governor,be reminded,your brother will have a mamoth task to defend a number of civil proceedings, libels,criminal contempt proceedings and other cases against him in the ensuing days so you better also step aside from ESP Governor duties and help your brother as you conflict of interest situation may impinge on your mandated duty to your people. And finally the perception that your kind has on the suspicion that you are held in contempt is all wrong.It is just a concoction of figment of your own insecurities.We are all your kandre mana and hold you in high regard and have mo such feelings. Finally,If you want to hold judge Kandakasi accountable for his remarks in court,do it through the proper avenue.After all em "het wara" blo u. Cheers all.
