The substantive hearing on whether Marape was properly elected the Prime Minister was completed at about 4:20 pm today. Belden Namah’s lawyer made the application to declare the election unconstitutional, invalid and void. This was opposed by respective lawyers representing James Marape and the Attorney General who both argued that the procedures of Parliament are non-justiciable and therefore the court should not interfere. Counsel for the Registrar of Political Parties and Candidates surprised James Marape’s and the Attorney General’s Counsels by argued in support of Namah’s motion and also additionally drew the court’s attention to Supreme Court authorities which showed that the Supreme Court actually has the jurisdiction to hear the matter. He also summited to the court that should the court find James Marape’s election invalid, Supreme Court ought to recall Parliament within 7 days to conduct the election of a Prime Minister. Lawyer representing Belden Namah, in courtroom competency, replied to the submissions made by lawyers representing James Marape and the Attorney General. Namah's Counsel further submitted that should the Supreme Court find the election invalid, the Caretaker Prime Minister until the new election for Prime Minister would be Peter O'Neill in accordance with Section 147(2)(a) of the Constitution. Chief Justice, upon conclusion of today's submissions, indicated that the decision would DEFINITELY be handed down this week.
