The Waigani Committal Court has dropped all 26 sexual offense charges against Aiye Tambua, the Member for Goroka, for now. Magistrate Paul Puri Nii made this decision because of conflicting evidence from different police investigators. The case has been sent back to the police commissioner for further review. Magistrate Nii issued seven key orders. He told the police commissioner to fix the problems in the investigation process and manage the officers involved. He also ordered the appointment of a neutral investigator from the sexual offense squad to properly handle the case. Magistrate Nii stressed that the new investigators should work together to ensure a fair outcome. He mentioned that the case could be looked into again when the police commissioner is ready. Meanwhile, Tambua's bail has been refunded, and all related obligations have been canceled.
This decision was influenced by an affidavit from investigator Adriana Kamasunga. She raised concerns about evidence held by Prosecutor Christian Iga, which her division was not aware of. Kamasunga argued that the Sexual Offenses squad should be in charge of the investigation because of the nature of the allegations. First Constable Kamasunga highlighted the pressure her team faced and the need for a complete police file. She asked the court to drop the current file to allow for a new, thorough investigation. The court took these concerns seriously, noting that disputes over evidence were hurting the police case. Magistrate Nii emphasized the need for justice and fairness.
