Ousted Treasurer, Don Polye is returning to court, to challenge the legality of
Government's borrowing of over one-billion Australian Dollars, about three-billion Kina from the Union Bank of Switzerland.... Polye's lawyer, Loani Henao told a Port Moresby news conference today, they've filed a proceeding at the Supreme Court, asking it to declare that the executive actions of the Prime Minister and Cabinet, in borrowing the money to buy over 10 per cent shares in Oil Search, without Parliamentary approval, is unconstitutional and illegal. The case is also seeking a declaration, that the loan agreement is illegal and unenforceable against the Independent State of Papua New Guinea.Polye's initial attempt to stop the loan early this month at the National Court, was unsuccessful.
