A POLICE officer in Papua New Guinea has been jailed for 18 years with hard labour for causing the death of a man who he had arrested for spitting betel nut in Kimbe when policemen were cleaning the town. Acting judge Justice Nicholas Miviri found First Constable Paul Karl guilty in the National Court in Kimbe of assaulting Emil Gare so bad he caused internal injuries to his head. “Policemen and women must show the way first to respect the law, not breach the law,” he said.
The court was told that Karl was among a group of police officers assisting Kimbe town officials cleaning the town on April 8, 2011. Karl saw Gare “spitting betel-nut” and tried to arrest him. Gare, however, resisted and punched the officer. “Gare was assaulted, apprehended and brought to Kimbe police station where he was further assaulted,” Justice Miviri said. Thirteen photographs were shown to the court of the “viciousness of the attack” on Gare. Doctor Philip Golpak conducted an autopsy on Gare and filed a report on April 14, 2012. He stated that the cause of death was “multiple head injuries due to multiple application of blunt trauma to the head”. Karl, 39, married with three children, is originally from Kurumugl village in Kundiawa, Chimbu. “He may have pleaded guilty but given these facts, it did not mitigate but aggravate,” Justice Miviri said.
