Papua New Guinea high Court on Monday dismissed two applications to stay the Reference on the election of Prime Minister James Marape. The applications for an interim stay and for an adjournment or interim stay were filed by Mr Marape and his deputy Davis Steven, also the Attorney General and Minister for Justice Kerenga Kua. They had asked the high court to stay the Reference on Mr Marape's election until another Special Reference on whether Belden Namah was Opposition Leader when he filed the Reference on Mr Marape's election is heard and determined. They had submitted that if the Reference on Mr Namah's standing was not heard and determined first, they will suffer prejudice. The three-men Supreme Court bench ruled they are not satisfied Mr Marape and Mr Steven will suffer any prejudice if their stay applications are not granted. The Supreme Court said however that the next step for the high court will be to determine Mr Namah's standing. The Reference by Mr Namah seeks the Supreme Courts interpretation of the Constitution relating to Mr Marape's election on 30th May 2019 by the Parliament and just before that election, the purported withdrawal of the nomination of Peter O'Neill and the actions of the Speaker in accepting that withdrawal.
