THE Marape Government Government is only acting on a court ruling to abolish the police department and the position of secretary to the department. Minister for Justice Bryan Kramer and Minister for Police William Onglo in a statement responded to questions raised on the recent gazette regarding the abolishment of the Department of Police and the Office of the Secretary for the Police Department. “The advice to revoke the 1976 Gazette G14 was based on the National Court’s judgment,” Kramer said. Kramer said paragraph 94 of the judgment stated: “Perhaps what the first and sixth respondents (Cabinet and the Government) should have done, in light of the controversy surrounding the Department of Police and its Department Head, is abolish the Department and abolish the position of Secretary of the Department of Police.
“But that was not done. “Perhaps it should be done in the future”. “Now that the court has made a ruling, this issue is no longer before the court so nothing stops the NEC from acting on the court’s advice,” Kramer said. He said the Cabinet decision to appoint the Police Commissioner was “no longer being challenged in court”. Onglo in a phone interview said Cabinet did not remove the Department of Police, “it has just revoked the position of Secretary of Police”. “The position of Secretary does not exist in our laws,” he said. “This means that the Commissioner of Police will no longer be referred to as (also) the Secretary for the Department of Police.” “The Commissioner of Police is selected from a pool of officers who have the rank of Assistant Commissioner of Police and Deputy Commissioner of Police,” Onglo said.
