THE National Court has refused sacked Deputy Police Commissioner Operations Simon Kauba’s bid for reinstatement.
Mr Kauba filed an application for stay last month and was heard by Justice Colin Makail on Tuesday. He said he was not given any opportunity to be heard on allegations made against him and that he only became aware of his sacking through a Gazettal Notice given to him. He claimed the National Executive Council did not inform him of the reasons for his termination in that position. Basically, Mr Kauba wanted to stay the NEC’s decision of June 18, 2014 that revoked his position as Deputy Police Commissioner Operations so he could be reinstated in that position. But Justice Colin Makail today refused this application in his ruling, on reason to maintain status quo as police is a disciplinary organisation that operates on a command structure. The judge said the position in dispute is not vacant as Jim Andrews is acting on the position after the change of top command from Sir Tom Kulunga to Geoffrey Vaki. He said reinstatement would not be necessary as it would create confusion and instability in the ranks and files within police force. The court also noted that Mr Kauba has substantive judicial review case still before another National Court involving his termination by the NEC. Comments are closed.
