The process of death penalty is important and must be understood by everyone, says a government representative.
Secretary for Justice and Attorney General, Dr Lawrence Kalinoe says, before putting someone to death all legal avenues available to an individual must be exhausted. Human rights of a person is accorded through the judicial process and then the government takes over as explained by Dr Kalinoe. "After appeal review fail thats were the judicail process ends. From there on the exective process kicks in. The executive govement is now in charge meaning that the implementation of the death penalty the actual execution is actually overseen by the exective goverment through the Correctional Service Minister." Dr Kalinoe. The government then decides on clemency or forgiveness or use power of mercy given under the Constitution to pardon an accused. Another opportunity is to release a person on licence. These options will only be available based on new evidence that may come after his/her judicial process is exhausted. If that fails, then one of the three methods of execution are approved for the prisoner to be put to death row.
