The National Court has thrown out the election petition against the NCD Governor Powes Parkop last Friday in Port Moresby.
The petition was filed in September 2012 by Michael Kandui, a candidate for the NCD regional seat in the 2012 general elections. The court headed by Justice Kassman threw out the case stating no basis of facts on the allegations were provided in the petitioner’s submissions. Mr Kandiu filed the petition on the allegations of bribery, illegal practices at the polling and counting venues, errors and omissions by the Electoral Commission and undue influence by Mr Parkop’s agents at the polling. The petition sought relief of the court to order a recount of the 12 ballot boxes from the Six Mile ward, a declaration that Mr Parkop was not duly-elected and a declaration that the election was absolutely null and void and a by -election be conducted. The court ruled that the pleadings made in the submissions were very general terms, unclear and insufficient facts to support the allegations.
