National Court today granted an interim stay (stop order) in two separate proceedings the first relating to the Commissioner of Police Gary Baki's decision to terminate Assistant Commissioner of Police Thomas Eluh and Deputy Director of National Fraud & Anti-corruption Timothy Gitua. Both men challenged their termination believing their termination was politically motivated. Both men were lead investigators into official corruption charges against the Prime Minister and
In separate proceedings the Court also stayed decision by the Chief Immigration Officer issuing a travel ban against National Fraud & Anti-corruption Directorate Australian based lawyers Greg Egan and his junior counsel Terry Lambert. With the Courts orders in place both Eluh and Gitua will assume full duties pending the Judicial Review of the Commissioner's decision to terminate them. The stay against the travel ban means their Australian based lawyers Egan and Lambert will be free to attend Court hearings and appear on their behalf in both proceedings. This is a momentous decision protecting members of Police Force from termination at will by the Commissioner.
