Justice Terrence Higgins sitting as a single Supreme Court Judge granted convicted criminal and former Commissioner of Police Geoffrey Vaki K5,000 bail late this afternoon.
Higgins former Chief Justice for Northern Territory of Australia recently appointed a Judge to PNG's Judiciary heard Vaki's bail application following his sentencing of 3 years by the Chief Justice Salamo Injia earlier today. Vaki's lawyers argued that their Client should be granted bail based on medical grounds, Vaki produced a doctors medical report that he had chronic medical condition since 2012 and further his incarceration (imprisonment) would prejudice the welfare of his family. Lastly Vaki would be eligible for parol after serving one third of his sentence (1 year) and if his appeal were to succeed he would have already served 1 year in prison. Damaru and Gitua's lawyer McRonald Nale appeared and vigorously opposed Vaki's request for bail he argued the Supreme Court may only grant bail in exceptional circumstances following a person's conviction and sentencing. Vaki has failed to provide any such grounds. However following submissions by both parties Justice Higgins upheld Vaki's application for bail. He has been released with bail conditions pending the determination of his appeal.
