The Ombudsman Commission, has referred Kavieng M-P and Public Enterprises and State Investments Minister, Ben Micah, to the Public Prosecutor, over alleged misconduct in office.
The Commission investigated the alleged misconduct in office by Mr Micah, which arose from his failure in upholding his duties and responsibilities of office as required under Section 27 of the Constitution and the Organic Law on the Duties and Responsibilities of Leadership. Chief Ombudsman Rigo Lua and Ombudsman Phoebe Sangetari said the Commission is satisfied that there is a prima facie case that Mr Micah has to answer. The Commission referred Mr Micah to the Public Prosecutor for its independent deliberation whether or not to bring proceedings against the leader as per the Section 117(1)(b) of the Constitution.
