The National Court in Waigani, has dismissed a case by former Prime Minister, Grand Chief Sir Michael Somare, against Speaker Theo Zurenuoc, for chopping down and removing cultural totem poles in Parliament.
The court ruling means, interim orders taken out earlier by Sir Michael stopping Mr. Zurenouc against further destruction to the cultural designs, are now lifted. The court dismissed the case on technical grounds, after finding evidence that neither the Solicitor-General nor his Secretary, were served a Section Five notice - an initial mandatory requirement before any legal action is taken against the state. Sir Michael's lawyer Danajo Koegeg told NBC News, while Secretary Lawrence Kalinoe accepted service of the notice, there was no evidence of that before the court, adding, this is not the end of the case. "We are going to go back again after we serve Section (5) notice," Mr. Koegeg said. Comments are closed.
