Police Commissioner Geoffery Vaki is calling on members of the general public not to misinterpret the Supreme Court ruling handed down yesterday.
The call comes in light of the Supreme Court decision, which basically answered questions to the Constitutional References that were raised in relation to the warrant arrest of Prime Minister Peter ONeill. A five-men Supreme Court bench ruled on the powers, functions, duties and responsibilities of the Commissioner of Police in relation to warrants of arrest. The ruling gives ultimate control to the police commissioner on directions to Police, regarding the conduct of criminal investigations, including applying for arrest and search warrants, and laying of charges. This now brushes aside rumours that the Prime Minister will be arrested. Separate applications filed before the court, raised Constitutional issues, therefore had to be referred to the high court for its interpretation. The ruling on the sixteen questions raised, will now guide the National Court, when it hears the Judicial Review appeal by Commissioner Geoffery Vaki and contempt charges filed against him by members of the Fraud Squad. They relate to the arrest warrant issued by the District Court for Mr ONeill on June twelve. The police commissioner was recognised under section 1-9-8 of the Constitution of the powers vested in him. However Mr Vaki can't interfere or stop the execution of the warrant of arrest, but through his powers, can only instruct his officers to withdraw the warrant through the court. Two matters will now proceed before Justice Les Gavera Nanu and Chief Justice Sir Salamo Injia.
