The Kokopo National Court has sentenced a young man to 15 years imprisonment for rape. However, the court suspended seven years from that sentence and the prisoner will now serve the balance of eight years on conditions that upon his release, he shall enter into recognisance to keep the peace and be of good behaviour for two years, his bail money shall be refunded and he was ordered to pay K600 compensation to the victim within six months and that the imprisonment term shall be served at Kerevat jail.
Benson Kekene was found guilty on three counts of aggravated rape. The court before Justice Salatiel Lenalia heard that in May 2012, the prisoner lured the female victim into a banana patch at Kenabot Stage One in Kokopo and sexually penetrated her against her will. The court heard that the prisoner had used a small bush knife to threaten the victim and raped her three times and also threatened to stab her if she shouted. In handing down his decision, Justice Lenalia said the evidence showed that within one or two hours of holding up the victim Kekene repeatedly had forceful sexual intercourse with the victim. He said having considered all addresses on sentence, the terms of pre-sentence and means-assessment reports, the principles of law on sentencing in rape cases and the totality principle, the prisoner was sentenced to 15 years for count one, eight years for count two to be served concurrently upon count one and nine years for count three to be served concurrently upon count one.
