ARTS, Culture and Tourism Minister and North Fly MP Boka Kondra (pictured) has been referred by the Ombudsman Commission to the Public Prosecutor for alleged misconduct in office.
He is the second Member of Parliament to be referred in a space of a week by the Ombudsman Commission. Last Thursday Manus MP Ronnie Knight was referred to the Public Prosecutor on alleged misconduct in office. The media statement released by the Ombudsman Commission was dated the July 9, but it was released just yesterday because of the Melanesian Festival of Arts in which Minister Kondra was the host Minister. According to the statement, Mr Kondra, was issued his "right to be heard" notice on December 16, 2013 and he responded to the allegations on January 20, 2014. The commission deliberated on the matter and was satisfied, for the purposes of Section 29(1) of the Constitution and Sections 17(d), 20(4) and 27(1) of the Organic Law on the Duties and Responsibilities of Leadership (Organic Law), that there was a prima facie case that Mr Kondra has been guilty of misconduct in office. On July 8, 2014 the commission informed Mr Kondra, in accordance with Section 20 (2) of the Organic Law on the Duties and Responsibilities of Leadership, that he will be referred to the Public Prosecutor and accordingly, under Section 29(1) of the Constitution and Sections 17(d), 20(4) and 27(1) of the Organic Law on the Duties and Responsibilities of Leadership, the Ombudsman Commission referred the leader to the Public.
