NVESTIGATIVE Task Force Sweep chairman Sam Koim says attempts by Police Commissioner Geoffrey Vaki to access criminal files under his (Koim’s) control is an attempt to interfere in the work of the taskforce.
Mr Koim said this yesterday in response to a written letter from Mr Vaki to his office – giving him 48 hours to surrender the files Mr Vaki’s November 26 letter said the order was conferred under section 14(1) of the Police Act. "Besides, there is only one Office of Commissioner created by section 198 of the Constitution and there is no place for a mini police force with a mini commissioner in duplicating the powers and functions of my office," Mr Vaki wrote. "I cannot sit back and continue to allow you to challenge the authority of my office. To do so would be akin to allow blatant breach of the Constitution of which I swore to uphold at all times. "Therefore, I now rely on my powers conferred by section 14(1) of the Act, and direct you to surrender all criminal files under your custody and control to my office within 48 hours. "These files relate to allegations of criminal conduct which is police business and comes under my jurisdiction as Commissioner. However, you have been unlawfully in custody of those files from the beginning hence my direction for their return. "Failure to do so is a criminal offence under sub section (2) of the same provision. Further, I will take whatever step lawfully available to me to recoup those files." But Mr Koim responded yesterday: "Your request under section 14(1) of the Police Act 1998 therefore is an attempt to interfere with all other powers endowed on ITFS. This is a purported exercise of powers in excess of your lawful jurisdiction, hence is unlawful. "Needless also to remind you that the National Court is proceedings OS (JR) 444 of 2014 issued a stay order, the effect of which allows our continued operation within the multi-agency framework.
