Lawyer representing the sacked Treasury Minister Don Polye says the government's K3 billion UBS loan has breached Section 209 of the Constitution.
The issue surrounding the loan has now become a legal matter as Mr Polye seeks the court intervention to stop the government executing the loan. Mr Polye's lawyer, John Napu from Napu and Company Lawyers said the matter was not brought to the floor of parliament for sanctioning as prescribed under Section 209 - clauses 1 and 2. "The simple thing the government have to do which they did not was simply comply with the requirements of Section 209. And so that a two processes ignored, one- the deliberation on economic viability of the loan and two- the constitution validity of the loan itself..." Mr Napu also states that the pace at which the transactions took place is also an issue off interest for the courts to look at. He said the government has gone against prudent advice despite prior advice from the State Solicitor to comply with Section 209 of the Constitution. Comments are closed.
